Appellate Practice
We have significant experience litigating appeals in both state and federal appeals courts. Mr. Klein's experience includes defending the appeal of Starke v. SquareTrade, Inc., a cutting-edge e-commerce case where the Second Circuit set limits to the enforceability of hyperlink arbitration agreements. The ruling was featured in the National Law Review and New York Law Journal.
Complex Commercial and Civil Litigation
We have extensive experience in complex commercial litigation, which is the Law Office’s largest area of practice. We represent individuals and entities in all areas of complex commercial litigation, including contract disputes, business torts, corporate law disputes, real estate disputes, partnership breakups and entity dissolution. The Law Office handles these cases at all stages of litigation, including motion practice, discovery, trial and appeal. The commercial cases we handle are most often litigated in the Commercial Division of the New York Supreme Court and the federal district courts, where we frequently appear on behalf of our clients.
Most recently during the COVID-19 pandemic, despite court closures and related delays, Mr. Klein successfully filed emergency motions and obtained attachment of assets on behalf of victims of fraudulent sales of medical PPE's.
White Collar Criminal and Internal Investigations
We advise and represent clients being investigated or charged with white collar crimes. Our experience includes representing corporate officers and employees before special committees conducting internal investigations, as well as representing clients before federal and state regulatory agencies. We have particular expertise in negotiating with corporate committees, regulatory investigators and prosecutors, and have been successful in discreetly resolving potential criminal exposure at preliminary stages of an investigation.
Employment Disputes
Our Office represents both employers and employees in employee disputes and discrimination claims. Mr. Klein has extensive experience in this area, including having defended a large hedge fund in a WARN Act class action by thousands of employees, defended the constitutionality of the Living Wage Act in Santa Fe, New Mexico, and recovered substantial awards for unpaid employees. Mr. Klein has also represented hedge funds in various disputes with former managers that established rival funds.
